Terms of Service
These Terms of Service ("Terms") govern your access to and use of the website located at CruxBody.com and any related services, content, and features (collectively, the "Platform") operated by Peak Labs LLC ("CRUX," "we," "us," or "our"). Please read these Terms carefully. By accessing or using the Platform, creating an account, submitting information, or purchasing any product or membership, you agree to be bound by these Terms together with our Privacy Policy and, where applicable, the Telehealth Informed Consent and the Notice of Privacy Practices of the affiliated medical group. If you do not agree, do not use the Platform.
1. What CRUX Is and Is Not
CRUX is a technology and brand platform that helps connect interested individuals with independent, licensed healthcare providers and licensed pharmacies. CRUX does not practice medicine, does not provide medical advice, and does not dispense medications. All clinical services are provided by independent licensed providers affiliated with [AFFILIATED MEDICAL GROUP, P.C.] ("Medical Group"), who exercise their own independent professional judgment. All prescription products, if any, are dispensed by [COMPOUNDING PHARMACY PARTNER] or other licensed pharmacies. Peak Labs LLC does not control, and is not responsible for, the independent clinical decisions of any provider.
2. No Medical Advice; No Provider–Patient Relationship Through the Platform
Content on the Platform is for general informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Using the Platform, reading its content, or submitting your information does not by itself create a provider–patient relationship. A provider–patient relationship is formed only if and when an independent licensed provider accepts you as a patient following an appropriate clinical evaluation, and only where permitted by the laws of your state of residence. Treatment is not guaranteed and may be declined at a provider's clinical discretion.
3. Not for Emergencies
The Platform is not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room. Do not use the Platform to request emergency care.
4. Eligibility
You must be at least 18 years old and physically located in a U.S. state where the relevant services are available to use the Platform. Services may not be available in all states and are subject to provider licensure and pharmacy restrictions. You agree to provide accurate information about your identity, age, and physical location, and you acknowledge that providing false location information may result in denial of services.
5. Accounts and Information Accuracy
You are responsible for maintaining the confidentiality of your account credentials and for the accuracy of information you submit. Inaccurate or incomplete health information may affect the appropriateness and safety of any care you receive. You agree to provide truthful, current, and complete information.
6. Memberships, Fees, Subscriptions, and Auto-Renewal
Certain services are offered on a one-time or recurring (subscription) basis. Fees, billing cadence, and what is included are disclosed at the point of purchase. Where a subscription auto-renews, you authorize us (or our payment processor) to charge your payment method on a recurring basis until you cancel. You may cancel as described at support@cruxbody.com or in your account settings, subject to the cancellation terms disclosed at purchase. Consultation, evaluation, and administrative fees may be non-refundable to the extent permitted by law. Fees for clinical services are separate from any product or membership fees and are set by the Medical Group.
7. Prescriptions and Pharmacy
Whether any prescription is issued is solely within the independent clinical judgment of the treating provider. No purchase of a membership or consultation guarantees that any particular medication, including any peptide or hormone therapy, will be prescribed. Products requiring a prescription are dispensed only by a licensed pharmacy following a valid prescription.
8. Intellectual Property
The Platform, including its design, text, graphics, logos, and the CRUX name and marks, is owned by Peak Labs LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or create derivative works without our prior written permission.
9. Prohibited Conduct
You agree not to misuse the Platform, including by submitting false information, attempting to obtain medications outside a legitimate clinical relationship, reselling or diverting any product, infringing others' rights, or interfering with the Platform's operation or security.
10. Disclaimers
EXCEPT AS EXPRESSLY STATED, THE PLATFORM AND ALL NON-CLINICAL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DO NOT GUARANTEE ANY PARTICULAR HEALTH OUTCOME. Individual results vary and no specific result is guaranteed.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Peak Labs LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING THE INDEPENDENT PROFESSIONAL LIABILITY OF TREATING PROVIDERS.
12. Indemnification
You agree to indemnify and hold harmless Peak Labs LLC and its affiliates from claims arising out of your misuse of the Platform or violation of these Terms.
13. Dispute Resolution; Arbitration
Any dispute arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by [ARBITRATION ADMINISTRATOR] under its applicable rules, on an individual basis. You and Peak Labs LLC waive the right to a jury trial and to participate in a class action, to the extent permitted by law. This Section does not apply to claims of professional medical malpractice, which are governed by applicable state law.
14. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, except where the law of your state of residence governs the provision of medical services.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted with a revised effective date. Your continued use after changes become effective constitutes acceptance.
